Background and Job Purpose
The International Catholic Migration Commission (ICMC) is an international
operating non-governmental organisation serving and protecting uprooted
people – refugees, internally displaced persons and migrants –regardless of
faith, race, ethnicity or nationality. ICMC advocates for rights-based
policies and durable solutions directly and through a worldwide network of
member bishops conferences, and alongside government and non-governmental
partners.
For its EIDHR funded project on “*Strengthening the Capacity of Indonesian
Civil Society Organizations (CSOs) to Promote the Protection of Migrant
Workers and members of their Families*”, ICMC is recruiting a Consultant
for the purpose of: a.) conducting a field assessment to gather data and
information on the implementation into national laws of the *International
Convention on the Protection of the Rights of All Migrant Workers and
Members of their Families* (ICRMW); and b.) updating and customizing the
information and statistical data contained in the ICMC ‘*Do-it-yourself
Kit on Strengthening Protection of Migrant workers and their families with
international Human Rights Treaties*’, to reflect the most recent changes
to the ratification status of the ICRMW and its practical implementation in
Indonesia (national laws; administrative acts; etc.). The information shall
be consolidated into a briefing booklet.
Indonesia is one of the biggest migrant-worker sending countries in Asia.
With the recent ratification of the ICRMW – adopted by the Indonesian
Parliament with no reservation on April 12, 2012, Law no.6/2012 – it is
envisaged that migrants human rights will be better guaranteed and that new
protective measures shall be enforced for millions of Indonesian migrant
workers during their migration process. Building on this encouraging step
and in order to maintain the momentum on the importance to improve the
protection of Indonesian labor migrants abroad, ICMC and its partners -
Solidaritas Perempuan and Migrant Care - are promoting the involvement of
Indonesia CSOs in enhancing accountability of national authorities in the
protection of migrant workers rights and are encouraging close monitoring
of the application of the Convention through the active engagement of local
CSOs.
Specific tasks:
*a.)* *Consolidating findings from field assessments for the purpose of
compiling a report with data and information on the implementation of the
ICRMW in Indonesia.*
Liaise with CSOs and participate in meetings with selected members of CSOs
and migrant workers in each target locations, for the purpose of gathering
information and data to be collected and analyzed in a report which shall
include an overview of the principal factors and measures contributing to
and/or affecting the application of the Convention, and suggest
alternatives. The field assessment shall focus on the migrants conditions
and the applicable legislation in the areas (provinces) of Jakarta, Cianjur
and Blitar. The report shall be drafted with a view to serve as a
supplemental source of information for consideration by the Committee on
the Protection of the Rights of All Migrant Workers and Members of their
Families, which is tasked to review the legislative, judicial,
administrative and other measures undertaken by Indonesia to give effect
and apply the Convention upon one year from its ratification.
More specifically, the consultant shall: Contribute in designing the field
assessment; participate in meetings (at least 5 meetings) with CSOs ;
compile and analyze data and findings; draft a final report in English and
or in Bahasa Indonesia (in full length report and summary in power point
presentation format).
*b.)* *Update t**he information and statistical data contained in the **ICMC
‘Do-it-yourself Kit for the purpose of drafting a briefing booklet on the
rights of migrant workers in Indonesia and the implementation of the ICRMW
into Indonesian national legislation. *
Undertake a desk-review to update the information and statistical data
contained in the Do-it-yourself Kit

the purpose of compiling a briefing booklet which will constitute an add-on
to the ICMC Do-it-yourself kit. The booklet will provide specifics on the
rights of migrant workers in Indonesia and the implementation of the ICRMW
into national laws; administrative acts; and etc. Gender sensitive data
shall be gathered and incorporated into the booklet. The kit currently
includes a compilation of treaties which define the international legal
framework for the protection of human rights of migrants and it offers
short narrative sections and user-friendly table formats which reference
key provisions of international treaties relevant to migrant workers. The
briefing booklet shall include tables to present the information in a
clear, concise, and user-friendly format; it shall be drafted in English
and or in Bahasa Indonesia.
qualifications and key competencies
- University degree (BA) in International Law, Human Rights Law or
other relevant discipline or an acceptable combination of relevant
education, job-related training and/or experience;
- Proven knowledge of migrant workers rights in Indonesia and
familiarity with the content of the ICRMW and its ratification process in
Indonesia;
- Advocacy skills an asset;
- Substantive experience in conducting field assessments and
compiling reports;
- Excellent oral and written language skills in English
- Proven experience in writing human right reports for
deliberation of international bodies (provide writing samples– e.g.:
web-links; report; articles; etc.);
- Computer literacy (MS Office and internet);
- Solid research, writing and analytical skills;
- Ability to travel and attend program related meetings in the
field
Duration
The maximum duration of the consultancy is 3 (three) months from 1 October
to 31 December 2012.
Supervision
The consultant will report to the ICMC Indonesia Head of Office and will
coordinate with the Program Officer for the Protection of Migrant Workers.
Remuneration
ICMC Indonesia offers an attractive consultancy fee, which is negotiable
depending on the experience and qualification of the candidate.
Consultancy fee will be paid in 3 (three) installments:
- 30 % immediately after the signing of the consultancy contract
- 30 % after the submission of the Briefing Booklet (November 2012)
- 40 % upon submission of a final draft of the report on the implementation
of the ICRMW (December 2012)
