*BACKGROUND *
The internal government monitoring system plays a crucial role in ensuring
the performance of government and preventing fraud and corruption inside
government institutions. External control institution such as the BPK and
KPK work *a posteriori*, while the internal monitoring system focuses *a
priori* (prevention side).
The government of Indonesia has several internal government monitoring
systems such as BPKP and the inspectorate general. While these mechanisms
provide valuable results, improving their effectiveness would enhance those
results. Some issues that could benefit from enhance efficiency are
professionalism, independence, and integration of the internal government
monitoring organization. Several efforts to address these issues are
underway, including the option to create a unified monitoring institution
which should lend the function more professionalism and independence.
MenPAN has been assigned by the GoI as the lead institution in drafting a
new internal government monitoring systems. It has established a task force
(working group) which consists of representatives of several IGs and
related experts from different government agencies.
USAID-funded SIAP 1 has worked with MenPAN since 2012 to accelerate
administrative reform efforts. Part of SIAP 1’s support to MenPAN is
facilitating its legal drafting working group. In this regard, SIAP 1 will
utilize the services of legal drafting consultant to assist the working
group in drafting the law. The consultant will work closely with -and under
supervision from- the chairman of the working group and provide his/her
expertise in translating the decision of the group into a draft law that is
in line with the Indonesian Legislation and legislative practices and
procedures.
*Objective: A draft law which clear, systematic, and complies with
Indonesian Law Making Procedure.*

*ACTIVITIES:*
Consultant will deliver services in:
1. 5 days for :
a. Learning on existing macro systems of the internal government
monitoring as a background of understanding monitoring systems.
b. Initial discussion/briefing with the chairman of the working group
on the current progress of the draft law creation.
2. 30 days for:
a. participating in each meetings of the working group in discussion
of the draft of law, including the meetings outside of Jakarta if any.
b. Provide advice to the working group on structuring the draft law.
c. Assist the working group to write the draft law, and ensure its
structure and wording is clear, consistence, and complies with Indonesian's
regulation on law making (UU nomor 12 Tahun 2011 on law making procedure).
d. Provide progress report to MSI SIAP 1 and the working group on
result of assistance
3. 5 dyas for:
a. Write the complete draft of law based on result of the meetings of
the working group
b. Provide final reports to MSI SIAP 1 and the working group on result
of assistance.
*DELIVERABLES:*
1. (Short) Assessment of current internal government monitoring
systems. (5-10 pages).
2. Written progress report and final report of assistance to the
working group, which at least covers reports on date of meetings, and
pointers of discussion topics. (10 pages)
3. Final draft of law on internal government monitoring systems.
*QUALIFICATIONS;*
1. Master in Law from a reputable university.
2. Professional legal drafter with at least 3 years experience in
legal drafting.
3. Good understanding of administrative reforms issues (understanding
of internal government monitoring systems is an advantage).
4. Committed to work and involve in all working group meetings
including seminar in selected regions.
