Position                                            : Legal Drafter Consultant

BACKGROUND 
The Central Information Commission (KIP) has improved its service in handling transparency on public information disputes as mandated by the Law Number 14/2008 on the Freedom of Information Access. KIP has the strategic mission to promote transparency and accountability of government and public institutions. One of its services is in managing mediation and adjudication processes in order to solve public information disputes as stated in the Information Commission Decree No. 1/2013 on Standard Service and Procedure of Public Information Disputes. MSI SIAP 1 has been actively contributing to this process by providing support to KIP during 2011-2014. KIP seeks to improve the decree periodically, considering the practical challenges that arose during its application.
In this regard, MSI-SIAP 1 continues its support to KIP in conducting the information dispute settlements.  MSI-SIAP 1 will hire one consultant who has expertise in legal analysis and legal drafting, good understanding on mediation, adjudication, and on the freedom of information law. The legal drafter consultant will assist KIP in conducting an assessment of the initial Information Commission Decree No. 1/2013 on Service Standards and Procedures of Public Information Disputes (Peraturan Komisi Informasi / PERKI). In general, the Consultant will be mainly tasked to assess and provide recommendation on the mechanism of procedural law of the mediation process, legal standing of the applicant, and to strengthen the execution after the trial verdict. Furthermore, the assessment is also expected to establish the legal of integrated case management system on public information disputes. The output of the assessment would be a draft of the refined Information Commission Decree No. 1/2013.
 
 
SCOPE OF WORK:
A.     Objective:  
The scope of work of the activity is to support KIP by providing substantive assessment and recommendation based on the initial Information Commission Decree No. 1/2013 on Standard Service and Procedure of Public Information Dispute (PERKI). As the primary reference material, the Consultant shall use the previous decree. Additional references that will be used to enrich the training module should be coordinated in advance and approved by MSI-SIAP I and KIP.
B.     Activities:
1.      Five (5) days for:
a.       Review and assess the Information Commission Decree No. 1/2013 on Standard Service and Procedure of Public Information Dispute
b.       Review other materials related to public information dispute
c.       Meeting with KIP in order to gain inputs on public information dispute
 
2.      Fifteen (15) days for:
a.       Drafting initial recommendations in Information Commission Decree
b.       Present the recommendation as well as draft of revised KIP decree.
c.       Provide inputs to the IT analysis consultant (to be hired separately) on the design of the case management systems to be in coordination with the decree.
 
3.      Five (5) days for:
a.       Drafting and present the final refinement of PERKI to KIP
b.       Drafting short paper as a guideline for the next technical consultant
 
DELIVERABLES
1)     Report on the assessment of PERKI
2)     Meeting reports with the KIP
3)     Recommendation of PERKI revision
4)     Draft of revised PERKI
Qualifications
1.       Be a personal consultant
2.       Minimum Master degree in Law or Public Policy.
3.       Minimum of 5 years of experience in doing law research, procedural law and/or access information law is preferred
4.       Demonstrated achievements in legal analysis and legal drafting.
5.       Have good and depth understanding on the mediation and adjudication issues
6.       Have a good understanding on the freedom of information law.
7.       Have a good communication and good personalities
8.       Have an experience working with government agencies is preferred
