REQUEST FOR QUOTATION
LEGAL ANALYSIS AND OPINION REGARDING LAND PROCUREMENT IN BINEREAN AREA,
NORTH SULAWESI
Cape Binerean, located in North Sulawesi, is an ecologically unique site,
since it harbours both the nesting sites of three IUCN Red-listed sea
turtles and the endangered maleo bird. Three species of IUCN Red-listed sea
turtles, Leatherback (Critically Endangered), Green (Endangered) and
Olive-Ridley (Vulnerable), nest in considerable numbers on the beaches of
Cape Binerean on the northern peninsula of the island of Sulawesi,
Indonesia. It is estimated that at least 500 turtles hatch annually, making
Cape Binerean a globally important nesting ground. Although the beaches of
Cape Binerean are remote, nevertheless these nesting grounds are threatened
by illegal harvesting of turtle eggs and the expansion of human
infrastructure. The beaches of Cape Binerean are also the nesting grounds
of maleos (Endangered), a bird species endemic to Sulawesi that, like the
turtles, also lays their eggs under the sand. And like the turtles, maleos
are threatened by illegal harvesting of the eggs and the expansion of human
infrastructure.
To address these threats to the turtles and maleos, WCS Indonesia Program
(WCS-IP) has supported PALS, a local NGO, to purchase the lands immediately
adjacent to the beaches, thereby stopping all new infrastructure. To ensure
the sustainable ownership and management of the Binerean area it is
critically important to ensure that all legal aspects and requirements under
the Indonesian constitution in regard to land purchase and ownership are
fully understood and respected. Taken the above into consideration, WCS-IP
would like to invite resourceful organizations and individuals to submit a
quotation for the following services:
Legal Analysis and Opinion regarding past and future land purchase in
Binerean Area, North Sulawesi:
. Compile and analyze existing documents (land procurement
letters, head of village agreements, village boundaries, spatial planning)
relevant to the historical procurement of land in Binerean Area (Mataindo
and Torosik) by WCS through PALS to obtain a better understanding on the
overall challenges and legal issues (coastal land, community tenure,
agricultural land, land certification, etc.);
Deliverable: List of documents, Document (chapter of report) with analysis
of legal challenges and issues related to land purchase.
. Provide a series of recommendations and options for ensuring
long-term and suitable ownership of the procured land, based on the existing
legal framework and in line with the conservation outcomes of protecting
maleo nesting sites and adjacent habitat;
Deliverable: Document (chapter of report) with options and recommendations
in regard to existing land.
. Develop a roadmap (technical and legal steps) as a follow-up on
the recommendations to achieve the legalization of the procured land in line
with its conservation objectives;
Deliverable: Document (chapter of report) with roadmap (i.e. technical and
legal steps required to legalize land).
. Analyze the legal status of PALS in relation to its current
status as owner of the land, and provide recommendations for eventual
changes in structure, etc;
Deliverable: Document (chapter of report) with legal analysis of PALS.
. Provide recommendations for the future procurement of land in
Binerean Area, in line with conservation objectives to protect maleo nesting
sites and adjacent habitat;
Deliverable: Document (chapter of report) with recommendation for the future
procurement of land in Binerean.
The consultancy is expected to take six to eight weeks to produce legal
opinion related to the above issues.
