Regulatory Reform Consultant
Individual Short Term Consultancy – Jakarta, Indonesia
Background
The
Government of Indonesia (GoI) has launched major business environment
reforms. The World Bank is supporting the work of the Indonesia
Investment Coordinating Board (BKPM)
in the implementation of a new Central One Stop Service (OSS – PTSP
Pusat). Alongside, and as an integral part of, the support for
implementation of the Central OSS, the World Bank team is also
supporting the simplification of business licensing processes
(i.e. regulatory reform) at the national level. The World Bank team
will carry out detailed mapping of licensing processes and develop
recommendations for simplification, for consideration by the relevant
interministerial working groups, coordinated through
BKPM. This support may also be expanded to the simplification of
licenses at the subnational level and support for implementation and/or
integration of subnational OSS.
In
order to support this exciting and high-visibility work, the Trade and
Competitiveness team of the World Bank’s Jakarta office is hiring 3
Short Term Consultants (STC). Each
Consultant will report to the Task Team Leader (Senior Economist) for
this project and work closely with the whole project team and GoI
counterparts.
Scope of Work
The
Consultant is expected to work within three broad areas. Specific
duties and accountabilities will be agreed upon based on the needs of
the project and depending on the abilities
and comparative advantages of each Consultant. The three broad areas
are:
1. General support
The
Consultant will be expected to support the team overall, as the project
evolves. Specific duties and responsibilities will be discussed and
defined in agreement with the team
leader. Such activities may include:

Regulatory/legal analysis and development of proposals for policy- or regulatory reform;
·
Collaboration with GoI counterparts and private sector stakeholders to draft revisions and/or new regulations;
·
Organization of or
support for outreach, capacity building programs and training materials
to gather public and private sector input to – and generate
buy-in for – policy reform proposals;
·
Tracking action plan
implementation and reforms among GoI counterparts and production of
detailed reports based on this information;
·
Preparation of information documents, such as memos or presentation, to update management on reform progress; and
·
Additional activities
or ad-hoc tasks consistent with the aims of the assigned position, as
required and directed by the team leader.
2. Central OSS implementation
The
Consultant will provide support to BKPM for individual elements of OSS
implementation, as needed, in close collaboration with the project team.
·
Assessment of the monitoring system for license tracking and OSS performance;
·
Development of recommendations for improvement of the monitoring system and OSS performance itself;
·
Collaboration with the
ICT Specialists in the project team and the relevant IT units within
GoI counterparts to support IT systems assessment and development
of reform recommendations; and
·
Working on-site for
OSS implementation, supporting BKPM staff directly in the implementation
of new systems, processes, and reform recommendations.
3. Regulatory review and simplification
The
Consultant will, depending on experience and ability as well as project
needs, support regulatory simplification related to OSS implementation.
·
Analysis of laws and
regulations related to business registration and licensing, across
different sectors, as discussed with and directed by the project
team;
·
Detailed mapping of licensing processes within the relevant GoI agencies and ministries, based on the legal/desk analysis;
·
Consultation with
relevant GoI agencies and ministries to confirm the accuracy of initial
mapping and document any deviations between licensing regulations
and practice;
·
Documentation to capture and display the results of the mapping;
·
Development and management of a repository for progress logs, underlying legal documents, as well as discussion notes;
·
Development of recommendations for simplification, in close collaboration with the team and with GoI counterparts;
·
Daily collaboration with the team to ensure smooth flow of information and progress reports; and
·
Ongoing collaboration with GoI counterparts across different agencies.
Applicants
should be prepared to work in at least one of these three areas, though
ideally in all of them at least to some degree.
Deliverables
Expected
deliverables will be specified for each Consultant individually,
depending on the specific work program agreed upon, as based on the
abilities and comparative advantages
of the Consultant, as well as on the needs of the team. It should be
noted that much of the Consultant’s deliverables will be in the form of
contributions to outputs developed by the team.
Qualifications
·
Either (a) a completed
university degree in law with experience in legal analysis, or (b) a
completed university degree in a field related to international
development, economics, or policy analysis with significant research
experience related to laws and regulations;
o
Preferred: graduate degree (M.A. or PhD);
·
At least 2-5 years of
work experience in conducting analysis of legislation and regulations,
preferably in the context of private sector development
/ business environment;
·
Preferred: demonstrated hands-on experience in legislation / regulation drafting;
·
Preferred: experience working with high level public and private sector counterparts;
·
Flexibility and creativity in working in a dynamic environment;
·
Excellent presentation as well as oral and written communications skills;
·
Ability to work with limited supervision and to think independently;
·
Ability to work
effectively under time pressure with high degree of accuracy and with a
strong capacity to produce high-quality work;
·
Proven ability to
demonstrate initiative, monitor issues and tasks, meet deadlines and
priorities, and ability to work in a team;
·
Ability to communicate ideas clearly and confidently, articulate issues and recommend practical solutions;
·
Active user of MS Office applications (Word, Excel, PowerPoint), ability in process mapping software ideal; and
·
Strong oral and written skills of both Bahasa Indonesia and English.
Duration and Location
The
assignment will be up to 265 days from March 2, 2015 – June 30, 2016,
depending on the Consultant’s availability. The contract may be extended
beyond that date, depending
on project needs.
The assignment will be located in Jakarta.
