GIZ assisted project "Capacity Building for the ASEAN Inter-Parliamentary Assembly (AIPA) to strengthen the parliamentary normative and control functions of member parliaments of AIPA and to support ASEAN to achieve its goal of establishing the ASEAN Community by 2015. The Project is funded by the Federal Foreign Office of the Federal Republic of Germany.


GIZ is searching for: Consultancy to Provide Facilitation and Subject Matter Expert Services to a Consultative Workshop on the State of Gender-Related Legislation and Participation of Women in the Parliamentary Processes of AIPA Member Parliaments project in Indonesia. I.  Specification of Services

1.2  Project Framework
In 2012 the Federal Foreign Office of the Federal Republic of Germany and the ASEAN Inter-Parliamentary Assembly (AIPA) have signed a cooperation agreement to strengthen the parliamentary normative and control functions of member parliaments of AIPA and to support ASEAN to achieve its goal of establishing the ASEAN Community by 2015.
The ASEAN Inter-Parliamentary Assembly (AIPA) and Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) agreed on the joint implementation of the project "Capacity Development for the ASEAN Inter-Parliamentary Assembly (AIPA)" commissioned by the Federal Foreign Office of the Federal Republic of Germany.
The project implemented its Phase I for the period 2014-2015 and pursued a three-pronged capacity development strategy: i) Support to AIPA institutional reform processes; ii) Advanced training measures for parliamentarians/ staff of relevant AIPA Committees, of the AIPA-Secretariat as well as of the National AIPA-Secretariats; and iii) Support to enhanced AIPA Information and Communication Management (AIPA Intranet, Awareness building).
After Phase 1 of the project ended in Feb. 2016, the Federal Republic of Germany and the ASEAN Inter-Parliamentary Assembly (AIPA) jointly agreed to extend the project for two more years ending February 29, 2018 which is termed hereinafter as Phase II. The summary of the project objectives, components and activities is described below:

This planned workshop as will be described in the latter sections of this Terms of Reference will contribute to the objectives of component 2 (Human Capacity Development).

2.0 Background and Rationale
The issue of the gender equality and the participation of women in the affairs of the parliaments within ASEAN Member States (AMS) is an issue that was initially addressed by AIPA way back in 1998 when it called for the creation of the Committee on the Women of AIPO or WAIPO during the 19th AIPO General Assembly held in Kuala Lumpur, Malaysia in 1998.

By virtue of Resolution No. 19 WC-GA/W/98/01, AIPO resolved to form Women Parliamentarians of AIPO or WAIPO to enhance the participation and representation of women within AIPO by endeavoring to bring about an increased number of women delegates to AIPO events. The said resolution also enjoined AIPO to increase women representation in Parliaments of the ASEAN member states and to bring forward specific concerns on women that should be discussed in the AIPO’s General Assembly. From then on, WAIPO met annually during AIPO’s General Assembly. The resolution also stated that WAIPO can discuss specific topic and organize conferences for the purpose. Since the renaming of AIPO into AIPA at the 28th AIPA General Assembly in Kuala Lumpur in 2007, WAIPO was also later renamed to WAIPA.

Despite the existence of WAIPA and the fact that some women in AMS have gained more prominence and empowerment to make decisions, gender inequality remains a serious problem in the ASEAN region where women reportedly continue to be denied justice because of deficits in the implementation of laws and their inaccessibility to social and economic opportunities and inability to exercise of their human, civil and political rights. This situation affects severely against women who are poor, women from racial and ethnic minorities, refugee and displaced women, women with disabilities and indigenous women. Violence against women in various forms as well as trafficking in women and children also remain widespread.

The enactment of gender equality legislation in the ASEAN Member States (AMS) is widely considered as a requirement for a broad framework to eliminate inequalities and discrimination directed towards women’s access and exercise of their human rights..  

Although all AMS already ratified the UN Convention on the Elimination of all Forms of Discrimination against Women (CEDAW) and Beijing Declaration and Platform for Action has already been passed by the UN more than twenty years ago, many observers still believe that there is a need to ensure that laws and administrative practices are non-discriminatory and the voices of women are heard because, in reality, justice remains out of reach for too many women in ASEAN.

It can also be noted that the ASEAN Inter-Parliamentary Assembly (AIPA), through its committee of Women Parliamentarian of AIPA (WAIPA) has adopted number of resolutions on women’s issue. Most resolutions call for the mobilization of parliaments as key mechanism to promote gender equality and ensure the rights of women and children are undertaken through legislative procedures. It has also underscored that women parliamentarians should play vital role in supporting the enhancement of parliamentary actions on this matter. Various adopted resolutions also reflected the commitment of AIPA/WAIPA to promote gender-equality.

The question now is, how far did the parliaments of ASEAN effectively passed relevant legislations to realize and implement the UN Convention on the Elimination of all Forms of Discrimination Against Women (CEDAW) and Beijing Declaration and Platform for Action? Corollary to this issue is the question of how extensive is the participation of women in the parliamentary processes among AIPA Member Parliaments in terms of decision-making and wielding of actual political power?

In the light of these two basic and fundamental questions, a consultative workshop is needed to gather baseline information on these subjects so that effective management interventions and future capacity development programs and activities may be designed for AIPA.   

The objectives of this workshop can be stated as follows:

At the end of the workshop, participants would have achieved the following:
1.) Gained basic knowledge and best practices on the extent of participation of women in the parliamentary processes among AIPA Member Parliaments;
2.) Gained knowledge and information relevant gender-related legislations which were passed by AIPA parliaments to implement the UN Convention on the Elimination of all Forms of Discrimination Against Women (CEDAW) and Beijing Declaration and Platform for Action; and
3.) Establish a network of professionals, advocates, parliamentarians and policy-makers who are working towards gender equality and gender mainstreaming within AIPA Member Parliaments.


3.0 Required Services of the Terms of Reference

This Terms of Reference aims to solicit proposals from a team of not more than two professionals who can jointly or individually design, facilitate and provide expert advice in the planning and implementation of this workshop. These two professionals can play separate roles as (1) Workshop Facilitator and a (2) Subject Matter Expert or Resource Person.

5.0  Quality Assurance

All work completed and submitted must be of high standard and quality.


6.0 Interaction and Communication with Involved Parties

The selected firm will be contracted by Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) and be primarily accountable to GIZ. All outputs and formal communication will be directed to GIZ. GIZ will apply quality controls and forward the outputs and formal communication to AIPA as applicable.
The selected firm will work under the supervision of and close coordination with Regional Expert/Technical Assistance Coordinator, Bernardo R. Agawin, Jr. (bernardo.agawin@giz.de)

The selected firm will direct any informal communication, particularly urgent ad-hoc advisory, directly to AIPA and GIZ. In doing so, the workshop facilitator will keep GIZ closely informed about all matters of substance and/or with organizational or logistical implications.


7.0 Expertise Required

The required expertise can be provided by a team of not more than two experts. The Tenderer must assign a Team Leader who is responsible for timely delivery and quality of all outputs, organizational and logistical issues of the experts, and all formal communication with GIZ.

Both members of the team should possess the following key qualifications:
1. At least have a Master’s Degree on Women/Gender Studies, or Social Sciences, or Political Science, or Legal Studies; 
2. At least five years of professional experience in training, planning, providing expert advisory services and implementing gender mainstreaming program in an inter-governmental institution or multi-stakeholder organization;
3. Must be conversant and knowledgeable on gender issues in ASEAN, UN Convention on the Elimination of all Forms of Discrimination against Women (CEDAW) and Beijing Declaration and Platform for Action;
4.  Excellent workshop facilitation or moderation skills (for the Facilitator); and
5. Complete Mastery of the English language (oral and written).

The tenderers proposing an Expert Team should add a short description of the division of tasks within the Team (as part of the Implementation Concept, ref. 8. Scope of the offer). The Experts/Teams who can best match these criteria will receive the highest score in the evaluation of the tender.

8.0 Participation of Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ)

GIZ is commissioned by the Federal Foreign Office of the Federal Republic of Germany to develop and agree with AIPA on the overall Project design as well as the individual activities. The Project concept is based on GIZ capacity building methodology and GIZ manages the project according to its planning, monitoring and evaluation system.
Specific tasks of GIZ within the framework of the activities described in these ToR are among others:

·         Selecting, contracting and monitoring the performance of the Expert;
·         Quality control of outputs by the Expert;
·         Correspondence with AIPA and joint coordination of implementation of activities;
·         Adjusting the Work Plan to new requirements occurring during implementation, including due coordination with all involved actors; 
·         Financial management;
·         Correspondence with German Embassies and reporting to the Federal Foreign Office of the Federal Republic of Germany;
·         Logistical and organisational preparations for all events;
·         Provision of venues for all events;

9.0 Scope of the Offer

Tenderers are requested to submit the following documents:
·         Curriculum Vitae (CVs) of the proposed expert(s) (Up to 4 pages per CV)
·         The Tenderer shall point out the specific expertise and proven experiences of the Expert/Team for each of the criteria listed in section 7 in a Description of Qualifications. The Tenderer shall describe in clear and concise language specific tasks performed, results achieved and provide contact details for respective references where possible. (Up to 5 pages)
·         The Implementation Concept/Proposal, including the methodological approach,
·         The Tenderer may - but is not required to - submit a Company Profile providing information on: (i)  key areas of expertise and relevant experiences, (ii) additional expertise and networks that can be activated, (iii) Company Registration and Tax payer Number, (iv) any other information to illustrate the Tenderer's capacities and competence to successfully complete the tendered activities. (Up to 5 pages)
·         The Tenderer may - but is not required to - submit an annotated Work Plan to comment and elaborate on the Work Plan provided with the ToR. If there are any restrictions in terms of availability of the Expert(s), the Tenderer must specify these and explain how outputs and overall results will nevertheless be achieved in time.
·         Other documents as mentioned in the invitation to tender.

10.0 Pricing and Payment Methods

The performance is to be offered at a gross fixed price in IDR or US$ (i.e. incl. any VAT and other payments or charges to be paid by the Contractors), including all costs incurred. If applicable: Please include separate price offers for each lot, also if you are bidding for the entire project. Please state the VAT separately for each lot and for the total amount.
In addition, the Contractor has to indicate:
·         The app. number of expert days being provided; please provide information on applicable daily rates (in US$/IDR/day/expert) – for information only
·         Add additional positions, if required
·         All and any payments shall be effected on presentation of an original invoice after the services have been rendered. Part payments may be effected as implementation progresses on presentation of an interim invoice according to the payment plan submitted by the Contractor.
·         If the agreed performance is not rendered, the Contractor shall have no right to the remuneration. If parts of the performance are not rendered, GIZ may reduce the remuneration accordingly.

II. Evaluation Criteria:
The quotations from the tenderers will be evaluated based on the criteria stated under point 8 and 10 of this ToR.
The contract will be awarded to the proposal that offers the best price-performance ratio. The performance, or quality of the proposals, will be weighted with 70% and the price with 30%.
A Company Profile will be considered as far as it comprises any implications for the Tenderer's ability to deliver the expected outputs and results.
